1. Acceptance of Terms
By downloading, installing, or using HandeeFriend (the "App"), you agree to these Terms of Service and Disclaimer ("Terms"). You must be at least 18 years old. If you do not agree, do not use the App. These Terms form a legally binding agreement between you ("User") and the operator of HandeeFriend ("we", "us", "our").
2. What HandeeFriend Is
The App is an AI-assisted home-improvement helper that provides estimated costs, DIY guidance, hardware shopping lists, photo-based analysis, and affiliate links to third-party retailers. The App uses third-party artificial-intelligence services (currently Google Gemini) to generate its output.
3. What HandeeFriend Is NOT
The App is NOT a licensed contractor, tradesperson, engineer, architect, electrician, plumber, or gasfitter. It is NOT legal, financial, insurance, real-estate, medical, or professional advice. It is NOT a substitute for in-person inspection or consultation with a qualified professional, and it is NOT a guarantee of accuracy, safety, code-compliance, or suitability for your specific situation. The App's output is provided for general informational and educational purposes only.
4. Assumption of Risk
DIY home repair is inherently dangerous. Risks include electrocution, fire, explosion, carbon-monoxide poisoning, falls, cuts, crushing injuries, exposure to hazardous materials, structural collapse, water damage, and death. You voluntarily assume all risk associated with any work performed based on information from the App, regardless of whether that information turns out to be accurate.
5. Hard Prohibitions
Do NOT use the App's guidance for: (a) gas-line work of any kind; (b) work on main electrical service panels; (c) disconnecting or reconnecting hardwired appliances; (d) load-bearing structural modifications; (e) work involving asbestos, lead-based paint, or mould remediation; (f) any work that requires a licensed tradesperson, permit, or inspection under your local building code. Tasks flagged as "Pro Only" or stopped by the Electrical Safety Gate must be referred to a licensed professional.
6. Permits and Local Codes
You are solely responsible for determining whether the work you intend to perform requires a permit or inspection under your local building code, and for obtaining any such permits before starting. You are solely responsible for ensuring your work complies with all applicable codes, standards, bylaws, and utility requirements.
7. AI-Generated Content Disclaimer
All guidance, estimates, product recommendations, part numbers, prices, and quote analyses are generated by AI. AI can be wrong. AI can hallucinate — inventing product names, model numbers, and specs that do not exist. AI may be out of date. You must independently verify all information before relying on it.
8. Photo, Location, and Data Handling
When you use a camera/photo feature, images are uploaded to Google's Gemini API for analysis. Your approximate location (city and country) is also sent to Google Gemini for regional pricing and codes. We do not operate our own servers and do not retain your photos or personal information. Your data flows directly from your device to Google's services and is subject to Google's privacy policy. Do not photograph or upload anything you are not willing to share with Google.
9. Affiliate Disclosure
HandeeFriend earns commission when you purchase products through links labelled Amazon, Home Depot, or Lowe's. We are a participant in the Amazon Associates Program and similar third-party programs. The existence of commission does not determine which products the AI recommends.
10. Third-Party Services
The App relies on services operated by Google, Amazon, Home Depot, Lowe's, and YouTube. Their terms of service and privacy policies apply to your use of those services, and we are not responsible for their content or practices.
11. No Warranty
THE APP AND ALL CONTENT WITHIN IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE HANDY NEIGHBOUR BE LIABLE FOR PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) CAD $100 OR (B) THE AMOUNT YOU ACTUALLY PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless HandeeFriend, its operators, owners, employees, agents, and affiliates from any and all claims arising out of your use or misuse of the App, any work you perform based on the App, any permit or code violation, or your breach of these Terms.
14. International Users
The App is operated from British Columbia, Canada. If you access or use the App from outside Canada, you do so on your own initiative and are responsible for complying with your local laws. Where local consumer-protection law grants you non-waivable rights (for example, the UK Consumer Rights Act, EU consumer law, or the Australian Consumer Law), nothing in these Terms is intended to override those rights.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
16. Dispute Resolution
Any dispute arising out of these Terms shall be resolved by (a) final and binding arbitration seated in Vancouver, BC, administered by the Vancouver International Arbitration Centre, or (b) at the claimant's option, in the BC Provincial Court Small Claims Division for claims within its jurisdiction. You and HandeeFriend agree that disputes will be resolved only on an individual basis, and not as a class or collective action, to the maximum extent permitted by law.
17. Changes to Terms
We may update these Terms from time to time. Material changes will trigger a version bump and will require you to re-accept the Terms the next time you open the App.
